Consent

CurbsideMD Messaging Policy

This Messaging Policy applies to SMS, MMS, Chat, and WhatsApp messaging channels. We all expect the messages we wish to receive will reach us without being filtered or blocked. CurbsideMD and our customers can take an important step to make that expectation a reality: to prevent and eliminate unwanted messages. In line with this goal, we strive to collaborate with our customers so that messages are sent with the consent of the message recipient and comply with applicable laws, communications industry guidelines or standards, and measures of fairness and decency.
 

CurbsideMD Messaging

Please note that all messages sent through CurbsideMD's platform, regardless of the type of phone number used (e.g., long code, short code, or toll-free), are considered Application-to-Person (A2P) messaging. All A2P messages sent from CurbsideMD are subject to this Messaging Policy, which includes rules and prohibitions regarding:
 

  • Consent ( “opt-in”);

  • Revocation of Consent (“opt-out”);

  • Sender Identification;

  • Messaging Usage;

  • Filtering Evasion and

  • Enforcement.
     

This policy applies to all customers who use CurbsideMD’s messaging channel.
 

Consent / Opt-in

Consent is never bought, sold, or exchanged. For instance, CurbsideMD will not acquire consent from message recipients by purchasing a phone list from another party.
 

Consent Requirements

  • Before sending the first message, Curbside will obtain the message recipient's agreement to communicate with them. Curbside will maintain records of the consent, including a timestamp for when the customer completed a sign-up flow.

  • The consent applies only to Curbside’s specific use case. It is not treated as blanket consent allowing Curbside to send messages from other brands or companies CurbsideMD may have or additional messages about other uses or campaigns.

  • Curbside will also provide proof that opt-in consent should be retained as set forth by local regulations or best practices after the end user opts out of receiving messages.
     

Identifying CurbsideMD as the Sender

Every message CurbsideMD sends will identify CurbsideMD as the sender, except in follow-up messages of an ongoing conversation.
 

Opt-out

The initial message that CurbsideMD sends to an individual includes the following language: “Reply STOP to unsubscribe,” or the equivalent using another standard opt-out keyword, such as STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT.
 

Users can revoke consent anytime by replying with a standard opt-out keyword. When an individual opts out, CurbsideMD may deliver one final message to confirm that the opt-out has been processed but will not send any subsequent messages. Curbside will re-obtain consent before sending any additional messages.
 

CurbsideMD Content Limitations

CurbsideMD will never send content that would be considered an abusive use of messaging platforms. In other words, CurbsideMD will not send any content that is illegal, harmful, unwanted, inappropriate, objectionable, confirmed to be criminal misinformation, or otherwise poses a threat to the public, even if the content is permissible by law. Other prohibited uses include:
 

Country-Specific Rules

All messages will comply with the rules applicable to the country in which the message recipient lives.
 

Age and Geographic Gating

Curbside will only send messages to users of legal age.
 

Message Retention and Archival

CurbsideMD collects and monitors the content of text messages that are transmitted via CurbsideMD’s platform as described in our terms of use agreement.
